Maintenance Terms of Service
Below are the Terms of Service for our subscription-based monthly services, which include but are not limited to WordPress maintenance, WooCommerce maintenance, SEO, and email marketing. We reserve the right to update or modify these Terms of Service at any time. While we may provide notice of any changes, it remains your responsibility to review the Terms periodically. By continuing to use our services, you agree to be bound by any revisions made from time to time.
Authorisation
You are engaging Pixaweb Solution as an independent contractor to perform the work outlined in the package(s) or service(s) you have purchased. If access to your website is required, you hereby authorise Pixaweb Solution to access and obtain “write permissions” for all necessary directories and files on your hosting account, as well as permission to install any required WordPress plugins for maintenance, security, or performance improvements.
Scope of Service (Site Maintenance)
By purchasing any maintenance plan from Pixaweb Solution, you agree to follow and comply with the Maintenance Plan Scope. The full scope of each plan can be found at the following links:

Support Hours
Each maintenance service provided by Pixaweb Solution includes a set number of support hours as defined in your Maintenance Plan Scope. Once your monthly limit has been reached, additional work will pause until the next billing cycle. You may request extra work beyond your plan, billed at $85 per hour, with a one-hour minimum charge.
Support hours do not roll over and expire at the end of each billing cycle.
Support hours apply only to the website covered under your maintenance plan, unless otherwise agreed in writing by Pixaweb Solution.
Copyright
Pixaweb Solution assumes no responsibility or liability for the content of websites it manages, maintains, or hosts. Any text, images, or media provided by you must comply with copyright and intellectual property laws. It is solely your responsibility to ensure that all provided materials are legally owned or licensed for use.
All digital assets created by Pixaweb Solution for your website or other approved platforms will have full copyright transferred to you upon completion and payment.
Ownership
Website Ownership: As a client of Pixaweb Solution, you retain full ownership of your website, including its content and intellectual property. Our role is to maintain and support your site, not to claim ownership of it.
Assets Created During Maintenance: Any custom assets such as graphics, images, or code created under your maintenance plan are for your website’s use only. You may continue to use these assets indefinitely, but they may not be sold, redistributed, or uploaded to marketplaces without written permission from Pixaweb Solution.
Premium Plugins under Pixaweb Solution License: If we install premium plugins licensed under Pixaweb Solution, you are not permitted to sell, sublicense, or redistribute them. These plugins remain bound by their developers’ license terms. Violation of these terms may result in service termination.
Pricing and Payments
All prices listed on our website are subject to change without prior notice. By becoming a client, you authorise Pixaweb Solution to charge the payment method provided for all invoices associated with services rendered.
If pricing adjustments affect your current services, you will be notified in advance.
To cancel a recurring payment or update your payment method, please contact Pixaweb Solution before your next payment due date.
Cancellations and Refunds
You may cancel your recurring monthly service anytime after the first 30 days. No refunds are available once a package or service has begun, unless otherwise approved in writing by Pixaweb Solution.
Refusal of Service
Pixaweb Solution reserves the right to refuse service to any individual, business, or website that contains offensive, hateful, malicious, or inappropriate content, or for any other reason at our discretion.
Third-party or Client Page Modification
WordPress clients may edit or update their websites independently after project completion. However, if someone other than Pixaweb Solution or its subcontractors modifies the website and causes functional or design issues, the time required to fix these issues will be deducted from your monthly support hours. Additional work beyond that will be billed at $85 per hour, with a one-hour minimum.
Limitation of Liability; Disclaimer of Warranties
We strive for your complete satisfaction, but certain limitations apply. Please review the following carefully before ordering services.
Pixaweb Solution does not guarantee that the functions or operation of your website will meet your requirements or be free from interruptions or errors.
You agree that your use of the website and its functions is at your sole risk. All services are provided “as is” and “as available” without any warranties, express or implied.
To the extent permitted by law, Pixaweb Solution shall not be liable for any damages, including but not limited to lost profits, lost data, business interruption, or other incidental or consequential losses arising from the operation or failure of your website, even if advised of the possibility of such damages.
Pixaweb Solution makes no guarantee that your website will be completely free from data loss, viruses, hacking, or other security breaches, and disclaims any liability related to such events.
This Agreement shall be governed by the laws of Queensland, Australia, without regard to its conflict of law principles. You agree that any disputes will be resolved exclusively in the courts of Queensland.
Acceptance
By submitting payment, you acknowledge that you have read, understood, and agreed to these Terms of Service. Pixaweb Solution reserves the right to update or modify these terms at any time without prior notice. This Agreement represents the entire understanding between the parties and may only be modified in writing and signed by both parties.
